Mt. Diablo Unified School District Bid #1887 Security Fencing at Bel Air Elementary School pursuant to PCC ยง20111.6. The scope includes new perimeter fencing of chain-link and wrought iron fence. Some trenching for fence posts. The invitation to bid indicates that the low bidder will be determined by the base bid amount and any additional add alternates only. A potential allowance was also included in the budgeting of this bid in the amount not to exceed $50,000. Five (5) bid packages were received on April 21, 2021. The DIR Certification was not received by Crusader at the bid opening. Crusader submitted a protest requested that the District waive on the ground of immaterial defects as the DIR number was included on their Bid form. District reviewed the protest and is recommending that the Board grant the waiver of immaterial defects based on the findings in Konica Business Machines USA, Inc v. Regents of University of California (1988) 206 Cal.App.3d 449, 454-455. In the application of this case law the District finds Crusader Fence Company, LLC is the lowest, responsible, responsive bidder.
